The application filed in by the ex- National Publicity Secretary of the Peoples Democratic Party, PDP, Chief Olisa Metuh which seeks for a medical leave to travel abroad for treatment has been rejected by the Federal High Court sitting in Abuja on Wednesday.
According to the presiding judge, Justice Okon Abang, he said that the court does not have the jurisdiction to grant the application owing to the fact that there was a subsisting order for Metuh to deposit his international passport with the Chief Registrar of the High Court.
On this ground, he said since the order has not being set aside, the court cannot grant his request.He furthered that one of the conditions for his bail was his deposit of his international passport at the court but the defendant did not vary the bail application.
In his words, “This is not a case of sympathy, but a case of law, this court has no jurisdiction to entertain this application.
“The court is not Father Christmas to give to the defendant what it did not ask for. The application lacks merit. It is accordingly dismissed. The court cannot set aside its decision.”
