The embattled national chairman of the Peoples Democratic Party (PDP), Senator Ali Modu Sheriff, has restated his will to appeal the judgment of the Federal High Court that affirmed his dismissal as the chairman of the party.
Speaking about this at the press conference that was held in Abuja yesterday said that the order of the Federal High Court, sitting in Abuja that validated his position as chairman cannot be overruled by a court of equal jurisdiction.
He added that the only court that can upturn the ruling of the high court is Court of Appeal. “We disagree with today’s (yesterday) judgment completely. We’ve asked our lawyers to immediately file an appeal and also ask the same Federal High Court for stay of execution because there are three orders before his (judge’s) own, which are of the same coordinate jurisdiction.
“Unless and until the Court of Appeal, which is a higher court, makes a pronouncement contrary to what we have, I still remain the chairman.
”The court that gave judgment in Abuja, last week, and the Federal High Court in Lagos and the Port Harcourt court have same competent jurisdiction.”
Makarfi who reacted to the judgment said, “I am also sad that it had to come to this. For me, there should be no winner or loser on this matter. I’m still calling on Senator Ali Modu Sheriff and his followers to join us so that we accommodate one another and, indeed, all other groups in a just, fair and equitable manner, with a view to moving the party forward.”
